Petition for Removal of Commonwealth’s Attorney for Loudoun County Buta Biberaj

  WHEREAS, Virginia Code Section 24.2-233 states in pertinent part: “Upon petition, a circuit court may remove from office any elected officer … [f]or neglect of duty, misuse of office, or incompetence in the performance of duties when that neglect of duty, misuse of office, or incompetence has a material adverse effect upon the conduct of the office.”

  WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj failed to follow the law regarding her obligations under the Freedom of Information Act, Virginia Code Section 2.2-3700 et seq. until ordered by a judge in the Loudoun County General District Court to comply with her legal obligations as an elected official;

  WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj is a member of a Facebook Group “Anti-Racist Parents of Loudoun County,” an organization that targets Loudoun County citizens and parents who object to the teaching of Critical Race Theory as part of the Loudoun County Public School curriculum;

  WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj deliberately misled Chairman of the Loudoun County Board of Supervisors Phyllis Randall about staff members that she had hired privately and unlawfully outside of the County hiring process;

  WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj has refused to properly prosecute defendants in numerous domestic assault and battery cases resulting in victims of domestic violence cases feeling alienated and therefore unimportant;

  WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj directed her assistant Commonwealth’s Attorneys not to discuss expectations and/or desires about the outcome of pending cases with victims and police officers in direct contravention of both the Virginia Constitution and Code of Virginia;

  WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj posted a response to a racist tweet stating that “White people are so embarrassing” in which she agreed and responded “Priceless” followed by seven hysterically laughing emojis signifying her contempt for a portion of the Loudoun County citizenry that she has been elected to serve.

  WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj has engaged in explicitly political prosecutions, and in a quid-pro-quo, agreeing to dismissing a case only when money was donated to Biberaj’s former employer.

  THEREFORE, with heavy hearts that circumstances have led the undersigned to seek the implementation of this unique remedy under the Code of Virginia Sections 24.2-233 et seq, the undersigned registered voters of Loudoun County hereby ask the Loudoun County Circuit Court to immediately suspend the Commonwealth’s Attorney for Loudoun County from her Office upon the filing of this petition, as allowed for by Virginia Code Section 24.2-236, and respectfully request this matter be subsequently set for a trial governing her removal pursuant to Virginia Code Section 24.2-235 et seq.
