Petition for Removal of Commonwealth’s Attorney for Loudoun County Buta Biberaj
WHEREAS, Virginia Code Section 24.2-233 states in pertinent part: “Upon petition, a circuit court may remove from office any elected officer … [f]or neglect of duty, misuse of office, or incompetence in the performance of duties when that neglect of duty, misuse of office, or incompetence has a material adverse effect upon the conduct of the office”;
WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj neglected her duties to follow the law regarding her obligations under the Freedom of Information Act, Virginia Code Section 2.2-3700 et seq. until ordered by a judge in the Loudoun County General District Court to comply with her legal obligations as an elected official;
WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj misused her office and neglected her duties by engaging in activities that resulted in her disqualification from representing the Commonwealth in a case where she had a statutory duty to do so. See Citizens of Leesburg v. Barts, Case No. CL21004859-00, thereby having a material adverse effect upon the conduct of the office of Commonwealth’s Attorney;
WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj has repeatedly agreed to the release, without good cause or legal justification, of dangerous offenders into the community resulting in further sexual assaults against students within Loudoun County Public Schools and the brutal and preventable murder of Regina Redman-Lollobrigido;
WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj demonstrated incompetence in the performance of her official duties by hiring a convicted child sex offender and provided them access to sensitive juvenile and sexual abuse victim files without conducting an appropriate background investigation;
WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj has mishandled and refused to prosecute defendants in numerous domestic and sexual assault cases resulting lesser consequences for offenders while leaving victims alienated and in fear of being further victimized, actions that have had a material adverse effect upon the conduct of the office of Commonwealth’s Attorney;
WHEREAS, the Commonwealth’s Attorney for Loudoun County Buta Biberaj has willfully misled the victims and their families, the public, the Loudoun County Board of Supervisors, and the media about her actions including the status and prosecutorial strategy in criminal cases, falsely claiming to save taxpayers $110 million per year by releasing jail inmates;
THEREFORE, we the undersigned registered voters of Loudoun County hereby ask the Loudoun County Circuit Court to immediately suspend the Commonwealth’s Attorney for Loudoun County from her Office upon the filing of this petition, as allowed for by Virginia Code Section 24.2-236, and respectfully request this matter be subsequently set for a trial governing her removal pursuant to Virginia Code Section 24.2-235 et seq.
